The PIVOTal Moment: Pandemic Pause to Passion (Working Title)

This agreement documents your permission to participate as a Contributor in the publishing of the Work, a Book and derivatives of The PIVOTal Moment:  Pandemic Pause to Passion (Working Title).  The Work is Co-Edited by Sharon Phillips Jarrett, CEO of Jarrett Affairs, Inc. (JA), and Jylla Moore Tearte, Ph.D., CEO of Crystal Stairs, Inc. (CS), hereafter known as CS/JA.  CS/JA are incorporated  separately as businesses who have formed this partnership to jointly produce this Work and its derivatives under the publishing entity of Crystal Stairs Publishers.  The “Work” will be used to reference the Book and derivatives in this “Agreement”.  

“Contributor” represents the Author of the story in the Work which will be in the form of an essay in the Book or other derivatives.  These essays will be known as the “Contribution” and are requested to be 1200-1500 words, 12 font size, Times New Roman font and single spaced.  Information relative to the publication and release of this Work shall be held in confidence until written permission is given to Contributors.  Contributors should avoid but will be responsible for any plagiarism or use of name(s) that points directly to any individual.  The final Contribution approved by CS/JA for publication will be owned by the Contributor but open to use by CS/JA in the Work or future derivatives without additional permission required.  

Any litigation will be at the expense of the Contributor and CS/JA will not be held liable.  Review of this Agreement by the Contributor’s legal counsel is permitted.  Any future legal actions would be subject to mediation at the expense of the party who was ruled against in the mediation.  

Once this Agreement is signed, the Contributor will not have the option to “opt out” as it would impact the overall production of the Work.  This Agreement and requested attachments must be signed and submitted online no later than noon on August 16, 2021 along with the first draft of the Contribution.  Inclusion in the publication cannot proceed without a signed copy of this Agreement.  All submissions are subject to final acceptance for publishing and use by CS/JA.

    • Submit an entry at the top of the page and the system will open a separate window.
    1. The Contributor assigns copyright to CS/JA during the full term of the copyright and any extensions or renewals of all copyright in and to the Contribution, and all rights therein, including but not limited to the right to publish, republish, transmit, sell, distribute and otherwise use the Contribution in whole or in part in electronic and print edition of the Work and in all media of expression now known or later developed, and to license or permit others to do so.  
    2. Reproduction, posting, transmission or other distribution or use of the final Work in whole or in part in any medium by the Contributor as permitted by this Agreement requires a citation to the Work and an appropriate credit to CS/JA, suitable in form and content as follows:  (Title of Contribution,  Contributor, Book Title, Co-Editors, Publisher, Copyright © [2021 year TBD].  Links to the Contributor’s final Contribution and the Work are encouraged in marketing and on the Contributor’s website with links to purchase.
    3. The Contributor agrees that any and all copies of the final published version of the Work or any part thereof distributed or posted by them in print or electronic format as permitted herein will include the notice of copyright as stipulated in the Work and a full citation to the Work as published by CS/JA.
    4. The Contributor affirms that this is an original Contribution and has the right to grant this permission of use.  
    5. The Contributor authorizes and grants the Co-Editors the right to use and to publish the name, headshot, biographical information and business information as submitted online by the Contributor.
    6. The Contributor will retain rights as noted in this Agreement for Contributions to the Work.
    7. The Contributor will not be assessed a fee to publish their Contribution in this Work. Part of the proceeds from the book with be donated to charitable organizations.
    8. CS/JA will provide a one-year report after the launch date.
    9. The Contributor may sell Books in person or via their website when they deliver the Book directly to the purchaser and retain the profits.  Contributors are invited to establish revenue ventures and streams within their own individual businesses and opportunities that do not conflict with the CS/JA partnership.
    10. CS/JA will determine the sunsetting of this Work and communicate the plan to the Contributors.  An option is to continue with the project for a given period of time or indefinitely at the discretion of CS/JA.
  • Notwithstanding the above copyright statement, the Contributor relinquishes all proprietary rights by signature ascribed to this document.  Any future litigation related to rights, if applicable, would be the sole responsibility of the Contributor for resolution in all aspects.  If the Contribution is not accepted for publication by CS/JA, or if the contribution is subsequently rejected, this agreement shall be null and void.  

    CS/JA retains the right to select and use any and all contractors to advance the marketing and distribution of the Work and any derivators.  No Contributor or associated business entity can enter into a contract that obligates CS/JA.  Approval of deliverables will be at the discretion of CS/JA and payments the responsibility of CS/JA.

    The Contributor will be given the opportunity to suggest edits within 7 days of receipt of the edited draft.  CS/JA will approve the final edited copy for publishing.

  • Submitted Version.  

    CS/JA licenses back the following rights to the Contributor.  In the version of the Contribution as submitted for publication.  

    1. After publication of the final Contribution, the right to self-archive on the Contributor’s personal business or personal page or in the Contributor’s business.  The Contributor may not update the submitted version or replace it with the published Contribution.
    2. The right to transmit, print and share copies of the individual Contribution as desired.

    Accepted Version

    Re-use of the accepted and approved Contribution  (but not the final) version of the Contribution shall be by separate agreement with CS/JA.  Requests for permission should be addressed to CS/JA Permissions Department at Permissions@CrystalStairsPublishers.com 

    Final Published Version.  

    CS/JA hereby license back to the Contributor the following rights with respect to the final published version of the Contribution:

    1. Copies.  The personal right of the Contributor only to send or transmit individual eCopies of the final published version to family and friends or for business marketing purposes upon specific written request and shared with CS/JA, provided no fee is charged, and further provided that there is no systematic distribution of the Contribution, e.g. posting entire article on a website that is accessible for training, development, seminars, etc.  For those Contributors who wish to distribute copies more broadly of their Contribution than allowed hereunder (e.g. to groups or mailing lists), please contact CS/JA.
    2. Re-use in other publications.  The right to re-use the final contribution or parts thereof for any publication authored or edited by the Contributor where such re-used material constitutes less than half of the total material in such publication.  In such case, any modifications should be accurately noted.
    3. The Contributor agrees not to compete with any marketing activities that represent the collective Work without permission from CA/JA.  

    Oral Presentations.  

    The right to make oral presentations based on the individual Contribution.  Representation of the total Work can be shared with attribution as appropriate.

  • Contribution ABSTRACTS.  (Up to 250 words)

    Contributor must submit an abstract of the Contribution for use in marketing campaigns and to publicize the Work.  CS/JA retains the right to edit the abstract as needed for marketing purposes.  

    Contributors may re-use these unmodified abstracts for any non-commercial purpose.  For online uses of the abstracts, CS/JA encourages but does not require linking back to the final published versions.  

  • CONTRIBUTOR’S REPRESENTATIONS

    The Contributor represents that the Contribution is the Contributor’s original work.  The Contributor also warrants that the Contribution contains no libelous or unlawful statements, does not infringe upon the rights (including without limitation the copyright, patent or trademark rights) or the privacy of others, or contain material or instructions that might cause harm or injury.  

    The Contributor understands that CS/JA and/or Crystal Stairs Publishers reserves the right to remove anyone from the project for cause that damages the good of the collective Work.  If such removal occurs, the Contributor forfeits all benefits at the point of removal. 

    The Contributor is responsible for any income reporting that may be accrued from this collaboration as a Contributor.  CS/JA is not responsible for the financial reporting of the individual Contributors.   

  • CONTRIBUTOR BENEFITS

    The following benefits are offered to the Contributor as a participant in this publication of the Work, as planned.

    1. Become a published author
    2. One (1) Copy of the Book; Access to the eBook link complimentary for 6 months after release
    3. Discounted cost for additional copies ordered prior to launch date; Contributor discount if 10 or more copies ordered direct for period of availability by the Book fulfillment firm.  (Discounted cost to be determined when price set for the Book)
    4. Monthly update calls starting 30 days prior to release and ending 6 months after release date; Replays will be made available unless recording is not made as a result of an error.  Note:  Participants agree to be recorded whenever participating in a CS/JA marketing, training or developmental event.
    5. Coaching and sharing about personal projects during the monthly update calls
    6. One interview or feature in a blogpost by CS/JA;  Other opportunities will be provided as appropriate but not guaranteed
    7. Featured on the Crystal Stairs Publishing website
    8. Participation by CS or JA in a Contributor sponsored virtual call
    9. Inclusion of Contribution in applicable future derivatives;
    10. Collective Social Media marketing
      1. One social media announcement within 90 days of release
      2. One social media image with the Contributor and the Book
      3. Link to eBook excerpts
    11. Gain a lead magnet or speaking engagements
    12. Learn skills for your “solo” or next book: Process and marketing experience.
    13. Individual marketing package with Crystal Stairs Publishers contracted vendors ($297 fee) includes:  
      1. One standard graphic of the Contributor and the Book
      2. One social media announcement on two (2) of the Contributor’s social media channels (ie. Facebook page, Twitter, Pinterest, Instagram).
      3. Graphic of the Book in 3 formats
      4. 5 additional physical copies of the Book
      5. Short Promotional Video of the Work produced by CS/JA
    14. Jarrett Affairs will host a complimentary master class for contributors on “Planning a book launch in your local community”. Regular fee: $999
  • CONTRIBUTOR REQUESTS

      1. Participate in “Energy Coaching” Calls
      2. Post “I am an Author” on Release Day to FB, Twitter, and other social media networks; personal pages; your website with link to purchase
      3. Send announcement to your mailing list
      4. Purchase copies of the book (minimum 5) on Release Day
      5. Gift the book as holiday gifts on release day;  ask them to leave a review; they will enter the “review contest”
      6. Write a blog and/or Facebook post about your experience writing your story
      7. Tell friends and family about the book and ask to purchase on Release Day or order in advance; leave a review
      8. Put “author of (book title)” in email signature with link to the book to purchase
      9. Secure at least one book review on Amazon prior to release. eBook will be made available to potential reviewer.
